TERMS FOR SALE OF APARTMENTS IN THE HOLIDAY COMPLEX
" PRIVILEGE FORT BEACH"
I. REAL ESTATES. PRICES
The price and description of the real estates are defined
according the pricing of "The Developing Company".
The price of the real estate includes:
- The ideal parts of land which belong to the lodging – for
Bulgarian citizens and Bulgarian firms;
- The ideal part for the right of building – for
foreigners.
The terms of sale and pricing can be changed one sided
by the seller, and the latter will inform the commissioners
about that at least seven calendar days prior to the moment
of change.
The clients and commissioners can make reservations /a
promise for a future purchase/ of real estates in the complex
for a term of one calendar week, in which period the Seller
is engaged not to offer to third persons the respective
real estate.
II. TERMS OF PAYMENT
The real estates are offered for sale at the following
scheme of payment:
A/ 10% of the sales price – at signing the preliminary
contract for sale;
B/ 17% of the sales price – at finishing of the roofing
works;
C/ the rest of the price – at signing the notarial
act.
III. TRANSFER OF THE PROPERTY
The notary act can be signed before the readiness of the
apartment, too, but not later than one calendar month after
its readiness.
At signing the Notarial Act the whole price of the real
estate is to be paid /the rest of it/.
The purchaser has no right to use the real estate before
he has paid the whole contracted price.
The price of the real estate, offered by the Seller, is
formed with the condition, that the transfer of the real
estate will be completed at the tax estimation.
The expenses of the transfer are divided between the seller
and the buyer equally.
If the purchaser wishes the real estate to be transferred
at sales price, he pays through the seller the surplus
value added tax, estimated on the base, formed as a difference
between the tax estimation and the sales price of the real
estate. In this case the purchaser takes the increased
size of the expenses for the transfer of the real estate
at notarial order for the sums due to transfer at tax estimation.
IV. EXPENSES FOR TRANSFER AT NOTARIAL ORDER
The expenses for the transfer at notarial order include:
- local tax in amount of 2% of the taxable base;
- notarial fee /proportional to the taxable base/ according
a chart of the Notarial Fee Tariffs;
- fee for registration of the notarial act in amount of
0.1% of the taxable base;
- fee for copies of the notarial act in amount 3 BGN for
each copy;
If the purchaser wishes, "The Developing Company" can
engage with the activity of registration of the purchaser
as a proprietor of the real estate before the tax authorities
in Republic Bulgaria, which has to be accomplished obligatory
in two-month period of the transfer of the real estate
at notarial order. For this purpose the purchaser has to
authorize notarial the seller’s representative.
V. COMPLETION OF THE CONSTRUCTION
The construction will be finished in a condition suitable
for use until 01/06/2005.
VI. MAINTENANCE OF THE COMPLEX
The seller takes the maintenance of the tourist complex
and the purchaser obligatorily signs a contract with "The
Developing Company" with an annual fee in amount of
5, 70 EURO per square meter + VAT, with the following discounts:
- 4, 75 EURO per square meter for each apartment a year + VAT – with advance
payment for three years;
- 4, 00 EURO per square meter for each apartment a year + VAT – with advance
payment for five years.
